Brazil Market Entry Strategy: Channels, Trademark and the First 90 Days
An Arabic-first, evidence-led guide to entering Brazil: use official trade data, test one channel and partner, search and file the mark with INPI, and run a staged 90-day validation plan without inventing market figures or statutory deadlines.
DIRECT ANSWER
The safest Brazil entry is not an immediate nationwide launch but a documented sequence of tests. Define the product, NCM classification and selling model, then use Comex Stat to compare imports and exports by period, country and state. Test one route—such as a specialist distributor or ApexBrasil B2B meetings—while checking the partner’s references and import capability. Before promotion, search and file the mark with INPI after selecting classes and paying the GRU. If the company will import directly, review CNPJ, REDESIM, Habilita and Siscomex requirements with Brazilian accounting and customs advisers. Measure the first 90 days by qualified leads, quotations, pilot orders and margin, not impressions.
1. Start with an auditable market and channel hypothesis
Turn “Brazil” into a testable hypothesis: product, buyer, state or group of states, route to market and likely NCM code. Comex Stat says monthly import and export data are available from 1997 to the current year, with detail by NCM, origin or destination country, federation unit, transport mode and customs unit, as well as product groups and country blocs. On the page checked on 20 September 2026, the displayed series reached August 2026 and carried a 4 September 2026 update notice. Record the extraction date, product definition and query filters: trade data are not the same as demand or profit. Use them to select a starting hypothesis, then interview real distributors or buyers to validate price, specifications and buying cycle.
2. Design a staged route to market and vet the partner
For B2B goods or services, a practical test can begin with a specialist distributor, sales agent, institutional buyer or structured B2B meetings. ApexBrasil’s trade-fair program connects pre-qualified international buyers with Brazilian exporters, arranges profile-based meetings and offers on-site commercial support; it expressly says that it does not negotiate or assume responsibility for business outcomes. Treat the program as an introduction, not a guarantee. Ask each prospective partner for references, territory coverage, served sectors, logistics capacity, inventory policy, payment terms, trademark conflicts and after-sales plan. Start with a sample or pilot order and a short agreement with a defined territory. Do not grant exclusivity until written performance indicators and real customer evidence exist.
3. Sequence entity, importing and trademark work without confusing roles
If entry requires a Brazilian entity, DREI describes a limited company route that includes choosing activities under CNAE, checking partner eligibility, drafting the articles, checking viability, requesting a CNPJ, registering with the Commercial Registry, selecting the tax regime through MAT, and then obtaining licences and other registrations where required. REDESIM provides an online single entry for registration and legalisation; Paraná’s official page says its State Finance Secretariat joined the network on 1 September 2017 and that a state registration can be automatic, while higher-risk cases may receive prior review. Direct importing is a separate workstream: Receita Federal’s Habilita guidance refers to an active CNPJ, DTE adherence and operational, economic and financial capacity, subject to exemptions and route-specific rules. These steps do not protect a brand. INPI requires a similarity search, GRU payment before filing and ongoing RPI monitoring.
4. Turn the first 90 days into a learning and decision cycle
Divide the first 90 days into decision gates, not one undifferentiated marketing campaign. First, lock the product, buyer and channel hypothesis, and save the Comex Stat query and classification rationale. Next, interview partners and prospects, test the message, price and delivery terms, and begin the trademark search. Then run a sample or pilot order and test documentation, clearance and after-sales support with local advisers; a company registration or trademark application is not product approval or a sector licence. In the final phase, review qualified leads, response rate, quotations, pilot orders, collection time, logistics cost, gross margin and compliance issues. Decide whether to scale, change route or stop, documenting every assumption and source date.
WHAT TO DO NEXT
- 1
Write the product, buyer and channel hypothesis; run a Comex Stat query and record NCM, countries, states and extraction date; conduct an initial mark search. A one-page hypothesis memo and an interview-question list.
- 2
Interview prospective distributors or buyers and request references, coverage and commercial terms; decide whether the test will use a partner or direct importing. A shortlist of 3-5 partners with a verification log; the number is an operating recommendation, not a market statistic.
- 3
Obtain local advice on CNAE/NCM and licences; begin DREI/REDESIM or Habilita work where applicable; pay the GRU and file the mark after review. A compliance matrix, channel decision and trademark filing—or a documented reason to defer it.
- 4
Run a sample or pilot order, test documents, delivery and after-sales support, then review qualified leads, quotations, orders, margin and risks. A scale, change or stop decision with assumptions, sources and review dates.
LIMITS AND RISKS TO CONFIRM
- An incorrect NCM or CNAE classification can change tax, licensing or import requirements. Document product specifications and obtain Brazilian accounting or customs advice before pricing or shipping.
- A mark can conflict with an earlier mark despite language or design differences. Search the INPI database by wording and classes, then obtain specialist review before filing and brand spend.
- A local partner may lack real clearance, service or customer-access capability. Check references and operating structure; start with a pilot, non-exclusive terms and performance indicators.
- FX movement or payment terms can erase the expected margin. Model scenarios, define currency and responsibility for fees and insurance, and consult a bank or specialist under the current BCB framework.
- A trade fair can signal opportunity but does not prove demand or deal outcome. Convert each meeting into documented follow-up and a sample or pilot, measuring qualified prospects rather than badge scans.
FAQ
Frequently asked practical questions
Do I need to establish a Brazilian company before testing the market?
Not necessarily. A market test can begin through a buyer, distributor or local partner, but the sales model and product may trigger tax, import or licensing requirements. If your company will import directly, review CNPJ, Habilita/Siscomex and documentation with a Brazilian accountant and customs broker. If you will establish an entity, follow the DREI and REDESIM route and confirm viability and licences before committing to a lease, inventory or launch.
When should I search for the trademark?
Search early—before printing packaging, signing an exclusive partnership or spending heavily on advertising. INPI’s guide says a mark that is too similar to an existing mark for similar goods or services cannot be registered and recommends a database search. After selecting the classes, the GRU must be paid before filing, and the application should be monitored through the RPI and INPI systems. Registration is not immediate, so obtain legal review of the search and specification rather than treating a preliminary result as a guarantee.
Is attending a trade fair or B2B meeting enough to secure a distributor?
No. A fair is a discovery and qualification channel, not a deal guarantee. ApexBrasil says it arranges pre-scheduled meetings and provides commercial support, but does not participate in negotiations or assume responsibility for outcomes. Use the event to build a shortlist, then check references, territory coverage, import capability, inventory and payment terms. Require a follow-up meeting, a sample or pilot order and written performance indicators before granting any exclusivity.
